<p>Albisu&#8217;s defense is based on <a href="https://letstalkdefensivegunuse.com/deadly-force-for-self-defense/" target="_blank" rel="noopener">self-defense</a>. His attorney, Ken Padowitz, described the chaotic scene at the venue, explaining that Albisu&#8217;s wife and son were assaulted, with a DJ allegedly throwing a chair that injured the event planner&#8217;s wrist.</p>
<p>&#8220;They were able to get out, glass shattered everywhere, get out of this wedding facility, and wake up my client, Mike, who was sleeping, and he was told what happened at his wedding facility,&#8221; Padowitz recounted. He further explained that upon learning of the situation, Albisu instructed his wife to call emergency services and then took immediate action to protect his staff, property, and family from what he believed to be a dangerous situation caused by intoxicated guests. His goal was to deescalate the tension and end the party peacefully.</p>
<p>An artist used an Oculus Quest 2 VR headset to visualize the defendant&#8217;s experience. Padowitz emphasized the importance of this method, stating, &#8220;It may be the first time in the United States that virtual reality was admitted into a criminal hearing,&#8221; marking a potentially revolutionary approach to courtroom evidence presentation.</p>
<p><a href="http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&amp;URL=0700-0799/0776/Sections/0776.013.html" target="_blank" rel="noopener">Florida&#8217;s &#8220;Stand Your Ground&#8221; law</a>, enacted in 2005, removes the duty to retreat before using deadly force in self-defense. This law allows individuals to use force, including deadly force, if they reasonably believe it is necessary to prevent imminent death or great bodily harm to themselves or others, or to prevent the commission of a forcible felony. The law applies anywhere a person has a legal right to be, not just in their home, under what&#8217;s known as the &#8220;castle doctrine.&#8221; It provides immunity from criminal prosecution and civil liability if the use of force is deemed justified. However, this does not apply if the person using force was engaged in criminal activity or was the initial aggressor.</p>
<p>This technology uses images or videos taken when the event happened. If there&#8217;s enough data to recreate the incident accurately, it would put jurors or the judge in the defendant&#8217;s shoes.</p>
<p>This type of VR differs from what AI generates from some user&#8217;s input. It&#8217;s not as much of an &#8220;interpretation&#8221; as a 3D rendering based on crime scene evidence. In this case, the artist had existing images and videos to work off of.</p>
<p>The prosecutor or defense attorney could make objections just like any other evidence before the jury ever sees it, and not all video or testimony is allowed now. Evidentiary hearings are where this would get sorted out.</p>
<p>This is a promising new technology that should progress rapidly, and its development will be fascinating to watch.</p>

<p>This was after 32-year-old Brandon Harris, with 17 previous arrests, went on a string of home invasions in Florida.</p>

<p>Knowing when you can and can&#8217;t use your firearm in self-defense is important, and it&#8217;s not always legal if someone is breaking into your home. In most jurisdictions, you have to be in fear for your life or grave bodily harm. <p>Illinois has no &#8220;brandishing&#8221; law, but the offense can fall under the <a href="https://www.ilga.gov/legislation/ilcs/ilcs3.asp?ActID=3497&amp;ChapterID=39" target="_blank" rel="noopener">Illinois Firearm Concealed Carry Act (FCCA)</a>.  &#8220;Aggravated unlawful use of a weapon&#8221; in Illinois involves deliberately displaying a weapon intending to intimidate or threaten someone.</p>
<p>This offense is governed by <a href="https://ilga.gov/legislation/ilcs/fulltext.asp?DocName=072000050K24-1.6" target="_blank" rel="noopener">720 ILCS 5/24-1.6</a>: &#8220;The person possessing the weapon was engaged in the commission or attempted commission of a misdemeanor involving the use or threat of violence against the person or property of another.&#8221;</p>
<p>The town of Frankfort, IL, does use the word.</p>

<p style="color: #252525;">It happened at Mugs &amp; Jugs, north of Pensacola, Florida. The incident occurred around 1:30 a.m. last Sunday. When the police arrived, the person claiming self-defense was gone, and they took the man to the hospital with a minor stab wound.</p>
<p style="color: #252525;">It looks to be a self-defense case as the guy who got stabbed was the aggressor, according to the sheriff&#8217;s office, which told <a href="https://weartv.com/news/local/stabbing-at-mugs-jugs-in-escambia-county-investigated-as-stand-your-ground-case" target="_blank" rel="noopener">WEAR</a> News on Monday that the second person involved has been located.</p>
<p style="color: #252525;">ECSO spokesperson Morgan Lewis told the <a href="https://www.pnj.com/story/news/crime/2023/08/21/pensacola-bar-mugs-jugs-stabbing-ruled-self-defense-by-ecso/70640409007/" target="_blank" rel="noopener">News Journal</a>, &#8220;A person had a minor stab wound to the thigh and left forearm and was transported to a local hospital with non-life-threatening injuries.</p>
<p style="color: #252525;">It&#8217;s interesting to note that the authorities didn&#8217;t file charges against either person.</p>
<p style="color: #252525;">In an unrelated incident on Thursday, the Escambia County Sheriff&#8217;s Office reported that 25-year-old Tierra Binion was fatally shot after a brawl inside the bar escalated outside the building. The sheriff advised business owners to look into additional protection.</p>
<p style="color: #252525;"><a href="https://www.wkrg.com/northwest-florida/escambia-county/escambia-county-sheriff-speaks-on-safety-concerns-of-mugs-jugs-bar-following-deadly-shooting/" target="_blank" rel="noopener">Sheriff Simmons said</a>, &#8220;My suggestion to anyone that has an establishment would be to concern yourself with security. Whether you hire an off-duty deputy, whether you hire an off-duty police officer, or whether you hire security guards of some sort, I would suggest you do that. If you&#8217;re expecting large crowds, large crowds sometimes can unfortunately lead to arguments, and it&#8217;s always good to be on the safe side.&#8221;</p>
<h2>What is a &#8220;Stand Your Grund Law&#8221;</h2>
<p>A person who is lawfully present in a certain area and feels threatened need not retreat before using <a href="https://letstalkdefensivegunuse.com/deadly-force-for-self-defense/" target="_blank" rel="noopener">deadly force</a> to defend himself. Depending on the jurisdiction, different nuances apply.</p>
<p>&#8220;Duty to retreat&#8221; is the opposite of &#8220;standing your ground.&#8221; In jurisdictions that requires you to try to get away, even someone who is assaulted (or protecting a third party who is being attacked) may not use deadly force if it is possible to avoid the threat completely safely by retreating.</p>
<p style="color: #252525;">As quickly as these things escalate, you are typically going to be left to defend yourself.</p>

										<content:encoded><![CDATA[<p>A MAJORITY of states now have permitless carry, so gun-rights opponents cannot say the average law-abiding citizen wants more gun control.</p>
<p>On Saturday, Florida joined the growing ranks of states that have welcomed permitless carry or constitutional carry. There will be more to come, and if it wasn&#8217;t for the large metropolitan cities, we would probably already have more on board.</p>

Despite hitting the intruder twice in the face with a broom, he continued to advance toward her with a blank stare. Fearing for her safety, the homeowner called out to her 80-year-old partner, Charlie, to get his gun and call 911. Charlie fired a warning shot into the ground, but the intruder persisted and followed the woman into her fenced-in backyard.</p>
<p>The woman warned the intruder to back off and fired a warning shot above him. However, he continued to advance toward her, leaving her no choice but to shoot him. The intruder died from his wounds, and the case has been sent to the State Attorney&#8217;s Office for review.</p>
<p>Reflecting on the incident, the homeowner expressed her uncertainty about what the intruder intended to do but knew she had to protect herself. She described herself as a fighter and said that she was troubled by the thought of whether God would forgive her for taking a life.
