										<content:encoded><![CDATA[<p>A man was just shot in the head on the New York subway during an argument. This is after they brought in the National Guard and extra police last week to stop the chaos.</p>
<p>NYPD Chief Michael Kemper said a 36-year-old man being &#8220;aggressive&#8221; got into a verbal argument with a 32-year-old rider. The 36-year-old man pulled out a knife or razor and then a gun. The 32-year-old got the gun away from the man and &#8220;fired multiple shots.&#8221; Authorities took the original aggressor to the hospital, and he is in critical condition.</p>
<p>Police took the shooter, who would have been the victim, in for questioning, according to the New York Police Department.</p>
<p>During a news conference, Chief Kemper said they didn&#8217;t know if his actions would be considered self-defense.</p>
<p>The NYPD referred to the man who got shot as the &#8220;victim.&#8221; No, if he started it and brought the gun, that would make him a criminal. They took the actual victim away for questioning.</p>
<p>One video captures a woman on the subway floor, saying, &#8220;Where&#8217;s the NYPD, oh my God!&#8221;</p>

<p>Last week, 1000 additional National Guard troops and law enforcement were added to the subways on top of what was already there to prevent the out-of-control crime in New York.</p>

<p>Here&#8217;s a quick list of some recent notable events:</p>

<li>Yesterday, Chicago scanner traffic posted by <a href="https://twitter.com/SubxNews/status/1760043247865328052" target="_blank" rel="noopener">SpotXNews</a> reported, &#8220;Over 100 migrants attacking security, security are off duty, police officers.&#8221;</li>
<li>Police have arrested over <a href="https://wirepoints.org/video-migrant-crime-is-a-problem-that-extends-beyond-the-borders-of-chicago-fox-news/" target="_blank" rel="noopener">60 offenders in Oak Brook, IL</a>, at a single mall for robbery.</li>
<li>Yesterday, migrants threw bottles and other objects at <a href="https://www.officer.com/investigations/video-cameras/video/53097026/video-nypd-officers-clash-with-crowd-at-migrant-shelter" target="_blank" rel="noopener">NYPD</a> during an arrest at a shelter.</li>
<li>While trying to make an arrest, multiple attackers beat <a href="https://abc7ny.com/nyc-crime-officers-attacked-time-square-nypd/14373708/" target="_blank" rel="noopener">NYPD officers in Times Square</a> and were then released.</li>
<li>Over the weekend, four men in <a href="https://cwbchicago.com/2024/02/four-migrants-charged-robbing-cta-passenger-pink-line-chicago-police.html" target="_blank" rel="noopener">Chicago strangled and robbed</a> a guy on the train.</li>

<p>In a sanctuary city, police can&#8217;t arrest someone based on an immigration violation.<br />
Former NYPD Chief of Department Ken Corey told the NY Times that it is nearly impossible to know the numbers because they can&#8217;t ask about immigration status, so police do not track these crimes separately in many locations.</p>
<p>Multiple sources have informed me that most of these people prefer to use weapons with points. It&#8217;s important to recognize the serious threat that homemade objects like sharp knives pose.</p>
<p>These objects can be extremely difficult to defend against, and taking proactive measures to avoid confrontation is the best way to stay safe. One first-hand account I have is of a man chasing me with a shiv while I was taking pictures, including his. Fortunately, I was faster than he was.</p>
<p>Crime data should include immigration status so authorities can get a handle on how bad this is.</p>

<p>The driver says, &#8220;You&#8217;re disrupting traffic idiots, you can&#8217;t do that, it&#8217;s against the law,&#8221; and multiple people are yelling, &#8220;Run them over!&#8221;</p>
<p>He was obviously angered, and they&#8217;re lucky this didn&#8217;t escalate. It&#8217;s only a matter of time before this boils over.</p>
<p>Protesters blocked off the Holland Tunnel, Brooklyn Bridge, and Manhattan Bridge all at the same time. Unlike many recent protests, law enforcement stepped in and removed demonstrators.</p>

<p>He was clearly at his breaking point, and had someone pushed back, I have no doubt it would have ended differently.</p>
<p>What happens when a GROUP of drivers gets out and reacts to the protesters?</p>
<p>What happens if the person being blocked is a less &#8220;diplomatic&#8221; driver?</p>
<p>I&#8217;ve watched these groups up close and in countless videos. In reality, the makeup of these groups falls into 3 categories; fortunately, this was what I call &#8220;type 3,&#8221; the least aggressive.</p>
<p>I&#8217;ve already been embedded with group &#8220;type 2,&#8221; and this is a ticking time bomb.</p>
<p>We always talk about options, and if you watch carefully, you&#8217;ll see a protester trying to open his car door before he gets out. I understand the anger and frustration, but keep your doors locked and your windows up. Don&#8217;t get caught off guard.</p>
<p>If you get into this position, avoid letting them bait you, and getting out of your vehicle would not be my first choice. This group was out to annoy people, but some have no problem ratcheting things up a notch.</p>

										<content:encoded><![CDATA[<p>Besides red flag laws, there are yellow flag laws that not as many people know about. What are they, and what are the differences between the two?</p>
<h2>Red Flag Laws</h2>
<p>Red flag laws typically let anyone make a complaint with no check and balance system to ensure the allegations are true. This has the potential to be used for abusive or vindictive reasons. They go into effect without the person being accused knowing or even a criminal act having taken place. After receiving a complaint, a judge may issue a confiscation order, and the police can show up to take away the firearms.</p>
<p>The accused person doesn&#8217;t know who made the report and hasn&#8217;t met the person making the accusation. Plus, they haven&#8217;t necessarily been charged with a crime. The person has to go to court later to show they&#8217;re not a threat and deserve to have their Second Amendment rights restored.</p>
<p>Next, they have to ask the court to return their property. This route overlooks several amendments, including the Second, Fourth, Fifth, Sixth, and Fourteenth.</p>
<ul>
<li>Second Amendment: the right to keep and bear arms.</li>
<li>Fourth Amendment: protects people from unreasonable searches and seizures by the government.</li>
<li>Fifth Amendment: the requirement that the government cannot deprive a person of their freedom or property without going through the court system.</li>
<li>Sixth Amendment: A person accused of a crime has the right to confront a witness against him or her in a criminal action.</li>
<li>Fourteenth Amendment: It guarantees &#8220;due process of law&#8221; before the government may deprive someone of &#8220;life, liberty, or property.&#8221;</li>
</ul>
<p>No due process, no facing your accuser, no charges, nothing, just the accusation of being a threat by someone else.</p>
<p>Authorities also put a red flag order into the <a href="https://en.wikipedia.org/wiki/National_Instant_Criminal_Background_Check_System" target="_blank" rel="noopener">National Instant Criminal Background Check System (NICS)</a>. The federal system is what a licensed gun dealer (FFL) puts the information into when you buy a gun. When you purchase a firearm, you provide your personal information on <a href="https://letstalkdefensivegunuse.com/your-guide-to-atf-form-4473/" target="_blank" rel="noopener">ATF Form 4473</a>.</p>
<h2>Extreme Risk Protection Order</h2>
<p>An Extreme Risk Protection Order (ERPO) is the name you will frequently use when someone refers to a court order. An ERPO is what prohibits someone from purchasing or possessing guns and requires the person to surrender any guns they already own or have.</p>
<h2>Yellow Flag Laws</h2>
<p>The yellow flag laws are a little different. They still see the importance of keeping guns out of the hands of criminals and other dangerous people. However, they do it more constitutionally. Law enforcement can only make the initial complaint.</p>
<p>Anyone can report suspicious activity to authorities, even concerned family members, but only the police can submit the application. The accused person may be placed in protective custody, which is different from arrest because they do not take them to jail. Instead, they are examined at a medical facility. If a medical professional determines a risk of imminent harm, the court issues a temporary confiscation order, or ERPO.</p>
<p>The complainant cannot have guns or other dangerous weapons while the order is in force. The accused next goes to court, where the judge must evaluate if the complaint is a continuing threat. If so, they will lose the legal right to own firearms. They will get his Second Amendment rights back if they are not considered a threat.</p>
<h2>New York Complicated Their Background Process In September</h2>
<p>As of September, <a href="https://www.wivb.com/news/it-was-really-inconvenient-new-york-processes-all-gun-ammunition-background-checks/" target="_blank" rel="noopener">New York bypassed the National Instant Criminal Background Checks (NICS) system</a> and is now the point of contact state, meaning the New York State Police will process firearm applications. The New York State Police will contact the FBI to figure out if someone can not only buy a gun but also if they are <a href="https://nysnics.ny.gov/app/home/faq" target="_blank" rel="noopener">allowed to buy ammunition in New York State.</a> This adds another layer of bureaucracy that can complicate matters and could let someone fall through the cracks.</p>
<h2>Maine Mass Shooting and the New York State Police</h2>
<p>The New York State Police brought Robert Card to the Keller Army Community Hospital at West Point for his medical evaluation. It appears that they <a href="https://www.timesunion.com/state/article/maine-shooting-suspect-robert-card-wasn-t-18450627.php" target="_blank" rel="noopener">didn&#8217;t tell anyone at the State Police Bureau of Criminal Investigation</a>, which is the agency usually in charge of handling emergency orders. They could have triggered the <a href="https://www.ny.gov/programs/red-flag-gun-protection-law" target="_blank" rel="noopener">New York red flag law</a> at the time.</p>
<p>The State of New York has a twenty-page <a href="https://www.criminaljustice.ny.gov/crimnet/ojsa/standards/MPTC%20Model%20Policy-Extreme%20Risk%20Protection%20Order%20December%202022.pdf" target="_blank" rel="noopener">&#8220;Extreme Risk Protection Order Model Policy&#8221;</a> that law enforcement can use as a reference.</p>
<p><a href="https://www.wmtw.com/article/susan-collins-maine-yellow-flag-gun-laws-mental-health/45663430" target="_blank" rel="noopener">Senator Susan Collins from Maine said</a>, &#8220;It certainly seems that, on the basis of the facts that we have, that the yellow flag should have been triggered. &#8221;</p>
<p>&#8220;If, in fact, the suspect was hospitalized for two weeks for mental illness, that should have triggered the yellow flag law, and he should have been separated from his weapons. I&#8217;m sure, after the fact, that&#8217;s going to be looked at very closely.&#8221;</p>
<p>In the case of the <a href="https://letstalkdefensivegunuse.com/its-not-the-gun-mental-health/" target="_blank" rel="noopener">mass shooting in Maine</a>, two states were involved, and both may have failed to act under existing laws.</p>
<p>Red flag laws don&#8217;t follow due process and overlook rights provided by the US Constitution. Once again, if we don&#8217;t enforce the laws on the books, what good will it do to pass more laws?</p>

Carson and his girlfriend got up and walked down the sidewalk behind Dowling, who started kicking at mopeds and bikes. Instead of stopping immediately, they continued, and the altercation began.</p>
<p>Dowling said to Carson, &#8220;What are you looking at?&#8221;</p>
<p>NYPD Chief of Detectives Joseph Kenny said, &#8220;Mr. Carson begins to immediately try to de-escalate the situation.&#8221;</p>
<p>Carson told Dowling to &#8220;Chill, chill, chill,&#8221; and Dowling swung a knife. Dowling stabbed Carson three times, and one stab hit Carson&#8217;s heart.</p>
<p>On Thursday, the police arrested Dowling and charged him with murder with depraved indifference and criminal possession of a weapon.</p>

I spent this summer, like many of the past years of my life, watching people I care about get attacked by the police in the streets.&#8221;</p>
<p>Lozada-Oliva was a friend of his who told the <a href="https://gothamist.com/news/slain-nyc-man-remembered-as-tireless-advocate-beloved-colleague" target="_blank" rel="noopener">Gothamist</a>, &#8220;I know he would have wanted people to use his death as a means to talk about structural wrongs in the city.&#8221; the Gothamist went on and said, &#8220;To say would have seen his killer as a victim of the kind of broken systems he was working to fix.&#8221;</p>

<p>According to a friend named Acadia Cutschall, this isn&#8217;t the first time someone has attacked him. &#8220;I was present once when he literally talked a guy out of mugging him,&#8221; Cutschall told a local newspaper. &#8220;He gave him some money.&#8221;</p>
<p>This was a tragic yet preventable death. Just because you successfully de-escalated a situation or someone else did doesn&#8217;t mean you can repeat the outcome. It is a false sense of security to believe that something that happened before will work again. Maintain a gap between yourself and anyone who might be a threat, and do whatever you can to stay out of harm&#8217;s way.</p>
<p>That reactionary gap is what you need so you have time to respond and stay alive.</p>
